Terms and Conditions

By purchasing and thus engaging in our services you agree to the following:

• You acknowledge and understand these are perishable live "foods" and that size, texture, irregularities, and color vary from item to item.  You also acknowledge that small mammals such as squirrels, raccoons, chipmunks, and even some birds may in fact eat the items as a food source.  This includes but is not limited to:  pumpkins, gourds, kales, mums, and ornamental grasses and peppers.
• You acknowledge that payment is due prior to delivery.  We accept CASH, CHECK, SQUARE, VENMO, and APPLE PAY
• Though we DO NOT need inside your home at any point during installation or delivery, we DO need access to your yard, driveway and or front door.  As such, you agree to: meet us upon arrival if the home is gated, or provide access via a gate code or house manager/gardener/other person.  Additionally, all animals must be secured NSIDE the house prior to, and during our time on your property.  Purchaser assumes all liability & responsibility for any injury to installer due to injury from animals.
• This agreement DOES NOT include removal.  If desired, removal can be arranged for a separate charge.  Ask for removal pricing and schedule.
• Installation and delivery happen rain or shine.  The only exception would be in the case of extreme storms (lightening, high wind, tornado, etc) we will suspend all deliveries and installation temporarily during the storm and resume once the area is clear.
• You acknowledge that all items will be delivered in a healthy and "pristine" condition but some items, such as plants may require regular watering to maintain their appeal and beauty.  Purchaser agrees that items are delivered in an acceptable and living condition and assumes all responsibility to keep them alive.  There are NO refunds for plants that die due to lack of maintenance.
• Because we are dealing with perishable items, the purchaser agrees to accept all items in good and acceptable condition and assumes all responsibility for them the moment we leave.  Thus, ALL SALES ARE FINAL - there are NO refunds.  IF both parties acknowledge there was a failure to provide the item or service promised, then a suitable replacement will be delivered ASAP, but there are no refunds.
• Purchaser releases Porch Pumpkins KC and it's employees from all liability and assumes all responsibility and liability surrounding safety, tripping, damage, and any other hazard associated with installed decorations and plants as it relates to children, pets, homeowners, and visitors to the home. 
• Purchaser/homeowner releases Porch Pumkins and its staff from any liability associated with fire or open flame in lanterns, pumpkins, near hay bales or with additional decorations the homeowner adds after we have left.  No open flame should be on or near hay bales unless supervised and with proper extinguishing equipment nearby.  Never leave a lantern or jack o lantern burning unattended.
• Purchaser assumes responsibility for proper disposal of all items unless previously arranged with Porch Pumpkins.  Removal and disposal fees vary.
